dealer taking their time to deliver

So I purchased an old sp forage harvester in Quebec, I live in N.S. Delivery was included in the price and its been paid for, but I've been waiting over 6 weeks for it to arrive.
its always going to be leaving this week. just wondering what any of you people out there would do? I've been pretty patient thus far. There was no set date on delivery, but this is too long. Thanks for any feedback
 
Too late now but making the deal so that the delivery driver gets the payment check will speed delivery time,plus if something happens in transport its 100% on them.
 
Not much you can do except try and get your money back, or wait until they feel like delivering it, they have your cash already so no need for them to hurry. Take it as a lesson learned, don?t buy in Quebec.
 
to late to stop payment. May just be a lesson learned?? Went through that recently. Fella wouldn't deliver on his end, I stopped payment, fella sent check back {after I told him I had stopped payment} w/VOID written on it. Cost me some bucks to do that but safer.
 
I've had a couple of situations like that this summer. Talked to a guy last winter about resetting a couple of grain bins, the foundations were cracked and settling. Talked to him again late May and he told me that he'd be ready first part of July. He showed up yesterday and got rained out today. We're only doing 1 my big tractor is on the crane and I need it for my grain cart. Beans will be ready to cut this weekend we're scrambling with which of the smaller tractors can handle the cart. He didn't want the smaller 1's on the crane and when I lifted the bin I knew why.
The other thing was the power steering pump on our grain truck. When we cleaned bins out in June, it was leaking pretty bad kinda' check the engine oil and fill the power steering pump. I procrastinated until mid August before I took it off. I figured I'd order a rebuilt pump maybe take a couple of days. I generally go to carquest and he's always been darn good at getting what I need quickly. He couldn't come up with a rebuild and told me it'd only take a couple of weeks to send mine in and get it back. So I did. It finally showed up yesterday. My blood pressure is down at least until this weekend.
 
Except you'll never find a seller willing to make that deal. What if they deliver it 400 miles, and when it gets there, the buyer says "just kidding" or "I spent most of the money on cheap whiskey and women, and the rest I just wasted". You might be able to get them to go for half down, balance on delivery, but I think that would be pushing it.
 
I just had an Oliver motor delivered to my place from a used parts dealer about 250 miles away,paid him when we unloaded the motor.Of course I can give references that prospective
sellers can call that will vouch that I will do what I agree to.But like you say might not be workable in all situations but I'd rather be out the machine than out the machine and the money.
 
well I don't want to paint all Quebec with the same brush. It is my first purchase there, I have gotten a couple tractors out of Ontario, but arranged the trucking myself with a local company. I assume they are waiting for a back haul in my area but not good for business. They won't deliver without full payment and obviously even that isn't satisfactory

When you made the deal, did you do it in french?
 
Hi David,we live in PEI so we?re pretty close to you. Are you hoping to use it for corn this fall? Maybe a frank but respectful phone call explaining the need for delivery might speed things along but I?m guessing likely not. If they can?t get their rear in motion possibly they might consider refunding you what you already paid for delivery and you could arrange the trucking yourself. Try and remain calm with them and avoid threats. They have your money and equipment so there?s nothing you can say at this point to make them move if they just don?t want to. If they say theyd rather just haul it like agreed instead of refunding the hauling than ask them if they will give you a delivery date as your waiting for the equipment. If none of that brings any satisfaction you might want to contact a lawyer to see where you stand.
 
Thanks for the reply. we don't grow corn on our farm here as it would probably have to be seeded under plastic, BUT they don't know that. I've called pretty much every week, and I've been polite. hopefully eventually they will send it along. just not sure how long to wait before getting a lawyer involved or the better busness bureau.
 
That?s not too bad then,if they will at least put a delivery date on it you?d have somewhere to start. I wouldn?t at this point demand a delivery refund. In the mean time it might not hurt to see what it would cost to send someone local to go get it for you. Then you could say to them you know someone heading that way that could get it if they?d be willing to refund you the delivery portion before hand. If they won?t cooperate in the next few weeks it?ll be 2 months by then and I?d be visiting a lawyer if nothing seems to be going to happen.

here's a thought: Write down the time and date of your calls,make notes of conversations, and follow up with an e-mail...you then have a paper trail that there is a problem...i said/they said does not prove anything,if it gets nasty.

Barnyard, you could do a little research on this yourself and you will see how it could affect a court.
 
I've had good luck on equipment purchases in Quebec as have some locals, but we never used their shipping. Do you mind naming the dealer?
 
sodifer inc is the dealer. they just deal in used stuff and trucking also. I have emails and the invoice as well as confirmation from them of payment. They haven't answered any of my emails lately, just phone calls
 
I see your question: The person who has "notes/dates/times "of any conversations held, being they what you write....Perhaps I should
of wrote " notes as accurate as you can at the time" of who said what..as the hours past a person tends to forget when putting things to paper.

If This went to a court or settlement judge, the more a person appears and acts in a calm professional manner, with notes,dates and times, e-mails,
etc and has shown a civil effort to settle the situation, has a much better chance of being the winner.

And with e-mails that request a "viewers receipt", there is no argument of " I didn't get it", or a claim of the buyer not contacting the seller.
As in Buyer be Aware....Buyer be Informed.

I called again today and the guy said it was on the truck and leaving later today. we will see, fingers crossed
