So I started at the mine a few weeks ago and Monday I went in at 4 in the morning to do some odds and ends for an hour just to get more time in the paycheck, starting time for my shift is 5 AM. Then my supervisor tells me I can't do much more then 12 hours in the day 5 days a week so to not go over 60 hours a week because of the HOS deal. I have never been up on all this so please explain some to me please! Are they right or are they missing something? I never had to deal with this the last time I worked there, new to me!
 
After 11:59 min. I am required to fill out a log book. You have to show a break and you will need to show what you worked the days before you log also. I just won t work twelve hours. I am a hundred mile radius exempt. BTW, 14 is the max a day.
 
A lot depends on how much and when you drive. Gets complicated. You can work more hours but cannot drive after a certain point.
 
I should state that I stay on site running a fuel, lube truck! Two of us in the truck, I tried googling but never got it figured out in this situation!
 
It really depends on what your company works.
If you follow DOT HOS rules you can not work over 14 hours a day or more than 60 hours in 7 days.

But there is always exemptions to rules.

If your company works 7 days a week they can "choose" to change the 60/7 rule to 70 hours in 8 days.
If they are closed 1 day a week this is not a option.
And everyone that works for said company must work on the same rule.

If you take off 34 hours in a row it resets your 60/7 hours back to zero.
 
504 has it about right. You have 14 hours per day, 70 per week. You must show a 30 minute break before 8 hours are up. If you stay within 100 miles you don't need to log unless you work over 12 hours in a day. If you need to log for over 12 hours, but stay in the same city, you can log on duty not driving so you don't have to log each stop.

You can work as much as you want beyond those hours, you just can't drive. And you can't start work the next day til you take 10 hours off and 34 hours off if you use up your 70. In your case if you work beyond your 70 not driving, it still adds hours so you need the 34 to start again.
 
How can the CDL rulls affect someone working only on private property in a situation that should not even require a drivers licence? To me it sounds like he is no more required by law to have a drivers licence to work that somebody running a fork lift in a warehouse, even a walk behind unit. And time to get to work should not apply even if driving over the road.

If you never leave private property you do not fall under DOT HOS rules.
The company may be doing it to prevent law suits if you were to hurt someone after working long hours.

That is my opinion also. If you stay on-site, and never drive on public roads, D.O.T. rules do not apply.
 
I don't know if DOT rules would apply on a private site or not. HOS is the new Hours Of Service rules? For a new job I would follow the supervisors directions. If you work hours that are not authorized there is a chance you won't get paid for them or you could be written up.
 
Too many variables and not enough info.

Could be because of rules imposed by insurance for all "drivers" or people who drive as part of a job description.

Union company? Could because of union rules. Long time friend of mine works for a union construction company as a grader operator. He will get in trouble if he gets off the machine to move a traffic cone 1 foot because of the union.

Could just be company policy either for employee safety, keeping the payroll down or some decision making just isn't familiar with the laws.

good evening brownswiss, great to hear things are going good at the mine, hows big brother doing with the milking? kind of nice to get that weight off your shoulders and just go out there and do a days work for a days pay and have an actual paycheck in the bank at the end of the week :D none of the headaches of keeping it all going, I think of all the farm operations out there dairy guys have it the toughest, a 16 hour, 7 day, 365, grind. for the hours worked I think it has the least return/ hour. it's going to be nice to finally have some time to spend with the wife and kids and a little me time for brownswiss to put his feet up and just relax.
 
There is no maximum number of hours that you can WORK. There is a limit to how many you can work and still be legal to DRIVE.
after 14 or more working hours, you must take a 10 hour break before you can drive again. BUT, there is NO LIMIT to how many hours you can work NOT DRIVING.

This is a very common misunderstanding. The so-called 14 hour rule applies only pertaining top driving.
 
I?m sure they don?t care how many hours a day you work . But you?re only going to get paid for 12 hours!
