Ok, I did some research about loose horses In Tennesser,basically, common law applies. The owner has a responsibility to keep his farm animals up, and anyone coming in contact with a farm animal has a responsibility to avoid being harmed by them. The common law says that once you know that the farm animal is loose, you have to put them back up in a reasonable amount of time. BUT, if the animals "notoriously" get loose, then you are liable immediately. TN also has a barbed wire fence standard if you have that.
