I never heard of such a thing. There are 46 states with similiar laws. I know some live near Elkhart. So, What the real story?

The law is basically if you commit a felony and anyone is killed because of that felony your guilty of killing them.
A more common example is: your riding with some one. You stop at a gas station. You stay in the car. The driver goes inside and robs the gas station an kills someone there. You are charged with murder as well as the driver that did the shooting.

Yes that can happen, I get the South Bend Tribune and watched the whole thing in the news. I think the law is trying to scare some sense into the kids. There was also a shooting where a 2 year old boy was killed. The boy was 200 yards or so from a gang related shoot out. I don't know how many of these gangbangers are charged but the law is going for maximum time for all. joe

I don't quite follow that example, you aren't participating in the felony.
Your an accomplice before and after the fact.
It may seem strange but it is how it is.
The long and short of it is you really need to watch who you hanging around with.
These young guys think that drugs and alcohol work for them. Then they do some stupid stuff and are in trouble with the law.
The Elkhart 4 admitted they where going to steal from this fellow and did not see anything really wrong with it as they did not have any money. Never a thought of WORKING for money, no they just decided to STEAL for money. I say they got what they deserved.

I agree with you on the 4. But if you have no knowledge of the felony until after it's happened, how can you possibly be held for being an accomplice?

I don't believe we have heard the end of this. It is interesting to note the shots were fired by the home owner as none of the four had a gun. For me (I know others feel different) it is hard to understand how the world is a better place if this kid grows up in prison? Is there not; something better we can use taxpayer dollars for than to feed/house this person for 55 years?
