update on bad buyer

so tonight, had it all worked out, repo man showed up to get the tractor, guess, what? no serial tag, they removed it. we called cops, even with pics of me standing next to the tractor at my home farm, couldnt bring it home. what a world we live in. now it has game/trail cams on it from 3rd party holding it hostage, so cant just go get it without getting pictured. guess it pays to be a criminal.
 
I can,t remember what tractor it was you sold but lots of time it is also STAMPED in the frame somewhere besides the pin on tag. Someone on here may know where to look.

Took too much time for you to go and get it for what ever reason. Sorry to hear that.

What about the numbers on the block, rear trumped, or lift pump? Did you have pictures of any of those? You are dealing with a class A criminal. You need to think like them two days before they think of it.
 
I would think if it is your tractor and you got a bum check, (correct?) you could ask them to provide proof of payment couldn't you?
 
This is unfortunate. I'm wondering to what extent there are records of transactions, i.e. phone, paper and text messages - not just to you but others. A civil suit might be in order with such things subpoenaed if the law enforcement can't or won't help. Just the notice they are being sued, not just for the value of the tractor, but punitive damages (not to mention court costs) might scare them to get the tractor back to you. If they have to steal a tractor, they probably can't afford a lawyer and you can't grind off the serial number from a law suit.

As an old friend of mine use to say, "Sue their pants off!!!!"

It sounds like the local police aren't willing to do anything. You need to step things up a notch.

They gave you a check on a non-existent account. That's not the same as an NSF check, that's FORGERY! File a complaint with your local police.

They've removed the S/N tag from YOUR tractor. That's malicious destruction of property. File a complaint with the police at their locale. If you can't get any action on the part of the police (you may be dealing with a brother-in-law situation), complain to the DA.

Can't get any action out of authorities despite repeated requests? Go to the newspaper. Just keep up the pressure.
 
Go get the tractor and take the trail cameras at the same time. Delete the pictures off the camera and send them back. Oops did I say that out loud?

Sorry to hear of your dealings. We have jerk that owns land the we actually have land locked that we have numerous problems with each year, one instance where he kid and buddies were target shooting towards my shed in return I now have bullet holes in my shed, the property owner just said its not possible for bullets to travel that far, but the people who were standing next to the shed when the bullets hit tend to disagree.

Hope you win out on this deal, sick of dealing with bullies myself.

Like others have said, I'v worked on equipment of all kinds, and have yet to see a tractor that didn't have a serial number stamped on it somewhere other than just on the tag.

Beyond that, everyone else seems to have given some great advice, and you just need to step it up a notch and file charges to prosecute the guy that gave you the bogus check....but offer to drop the charges if the tractor is returned.
 
I don't know about where you are, but where I am, there is a whole book of criminal charges that can be filed.
Passing bad checks is a crime. The level of the crime is determined by the size of the check. A large check - like as for the purchase of a tractor - could even be up to a felony.
Taking a vehicle unlawfully - in this case by knowingly paying with a bogus check - amounts to theft, perhaps even grand theft.
Removing a serial number from a motor vehicle (or any large piece of equipment) is a FEDERAL crime. Might even give some jurisdiction to the FBI or US Marshal service.

Keep in mind that you are dealing with CRIMINALS here. They are not above breaking the law to suit their needs/desires. You need to get some real legal power behind you, and quit tip-toeing around. Get a good prosecutor on your side, hire a good lawyer, and prosecute to the full extent of the law.

At this point, you either fully commit to getting what is due to you or just let it go. There is no longer any halfway.
 
I filed a stolen tractor report, only to discover what they really did. They got another id tag, put it on there, called the cops out to inspect it. Cops said ok, it's not the tractor in question and dismissed my theft report. Then, removed the tag entirely. The cop I dealt with is now thinking I'm not telling the truth. I do have the numbers off the block. See, I called the repo guy, at 2pm, he didn't answer any calls or texts, then heard from him after he left. I gave him the numbers off the block as a secondary id, and sent pics to show. Got brushed off. Call a lawyer he said.
 
In my state bad checks are a felony no matter the amount especially if knowingly used to defraud someone . Was in court and saw a girl get sentenced to 2 years county jail for passing bad checks all under 50 dollars yes that's not the whole story she had written 2 to a check and loan place they hauled her in let her go and she did it again but we were still talking under 150 bucks total and they nailed her a** tithe wall so I can't think somebody writing a fake check on a fake account to steal a tractor will get off to well .
