Attention Truck Drivers

Just in case you have not heard. We are going back to the old 34 hour restart rules while FMCSA studies them and decides what to do about the rule.

President signs approps bill, changes to 34 hour restart into law

They changed the pti rules too, but they don't go into effect for a while yet. Just read that a couple days ago too. Dart sent us a notice on the 34 rule a day or so back.

Jon what are the current HOS rules? I been out of the over the road stuff so long I have no clue. I got to get my stuff in order as I'm trying to work a deal on a run that I will have to work the cursed log book.

70 hrs in 8 days
10 hrs off for a break
can not work past 14 hrs from start time (this includes lunch breaks so if you start at 6am you need to be off by 8pm even if you logged 2 hrs off duty.
11 hrs driving per day
34 hrs off will reset your 70 hrs back to 0 so if you take 34 hrs off you do not count any days before it in your recap
must have a 30 min break before 8 hrs on duty

was the rule but is not enforced while fmcsa studies the rule........
34 hr break must have two periods on 1 to 5 am
you can only take one 34 hr break every 168 hrs.

Are they still making you drive the 10.5 hrs straight or can you do a sleeper birth and not have it count on your hrs? I used to like that when traffic hit, I found it more comfortable laying down than holding a clutch down.

My company will not let us use it (if we go on break we must take 10 hrs off as we use motels and not sleepers) but there is a provision to split your sleeper berth. Jon probably knows more about it than I do.

From what I know you can split it in two and each piece must be at least 2 hrs long.

In addition to what John said there is also the 8 hour rule, this is realatively new and says that you need a 30 minute break every 8 hours. So 8 hours after you start you need to go off duty for 30 minutes before you can drive again. Also on the 14 hour clock, you can work past 14 hours you just can't drive. That means that when you start your day 14 hour later your done dtiving no matter how many hours you actually drove. You can legally do things like fuel, load/unload, do inspections ect after the 14hrs. After you quit working you need to take 10 hours of off duty/sleeper birth or any combination of the 2 before you can drive again. There is also a split sleeper option, but it's so complicated almost noone uses it.

The only way to stop the 14 hour clock is with 8 continuous hours in the sleeper only. That will stop the 14 hour clock, but then you need to add the 2 hours somewhere to complete your 10 and then after the 2 it gets really confusing because you can't excede the 14 without 10. So, I will use the 8 in the sleeper if I started my day early and get hung up at a shipper/reciever for close to 8 hours, that way I can drive til dark. But then I always shut down for 10 to clean it up so I don't have to worry about the 2. But to answer your question about stopping the clock for a nap to miss traffic, no you can't, the 14 keeps counting.

It's nitpicking I know, but in a split situation the 2 can be off duty and can include the 30 minute in 8 hours rule.

This is why noone uses it, it's not even understandable for the dot. I'm glad I have the electronic logs, it keeps track of everything for me. Lol

Yes it is one part of the rules I completely do not understand.
But then again I am never put in that situation to have to understand it.
99% of the time I go to work at 6am and am off by 8pm and do 10 hrs at home.
About 12 weekends a year I take a road run to Dallas or Atlanta to get a few extra $'s
I run terminal to terminal of less than 600 miles; go to the motel for 10 hrs and then back home the next day.

Our road drivers that stay gone all week run 600 miles and motel for at least 10 hrs so we never have the chance to deal with it. Only trucks we own with sleepers are team trucks and as you say peoplenet keeps them straight.

You know darn well they will make it even more convoluted than it already is. They are so worried about 8 uninterrupted hours of sleep but most of the world only sleeps 4 to 6 hours at night and a couple in the afternoon. I don't know the point but they are working to take any and all flexibility out of the rules and make them totally unworkable.

That is why they are called "FUNNY BOOKS"...!!!!

When a Trucker's day works according to that malarkey...(BTDT)....

I have to wonder just how many kids have grown up in the cab of a truck and never seen the inside of a School...(It has to be Plenty)...

Ron.

That half hour goof off period has to be before the 8th hour or you're in violation. OOIDA suggests to do it between the 3and 7th hours.
