sold item not picked up

i sold an item back in may of this year and received 80% of the amount. i have requested it bee picked up. how long should i hold it before putting it back up for sale? do i refund money received? thanks Eric
 
I would send him a letter by certified mail and tell him he has 10 days to pick up the item or you're going to resell it. Hal
 
I sold a 16 ft. portable grain auger last year in April on Craig's list. The guy paid me cash and said her would pick it up in a few days. He called me 5 months later to get it and I was in Tok, AK. about 5000 miles from home on my motorcycle. I told it it would be about a month before I would be home. He called me a couple months later and came and got it.
I get nervous about buying something at a farm auction, paying for it, and coming back to get it the next day. Yet alone buying and paying for something a waiting a few weeks or months later to pick it up.
 
all i have is a phone number and i cant get him on it he responds to text that he will pick it up.i need it off the yard the remaining 20% would be nice.
 
When the farm that dad ended up buying had the auction there was a dump rake on it. Dad bought this farm the year I was born and the dump rake was still on it then and after I graduated from high school it was still there. About 10 years ago the guy who bought it called and asked if by chance it was still there and dad said yes come and get it. Dad and this guy were classmates and friends just to clarify things.
 
Scrap it and have him pick up 20% of it that you leave left for him. I sold a 4020 to a guy one time, he wanted to make payments, I wasnt crazy about it but he said he would pay half now and half in two weeks, sent me half, two weeks went by, no money, month went by no money, comes up to a month and a half, I called him and said I will be taking off the wide front, 3pt, and fenders, and other parts until you have $3500 worth of parts that is left that you paid for, He paid for it within a couple of days then!
 
that all sounds nice. but the question is how long should i wait for this item to be paid in full and pickup? i could have sold it and gotten paid in full and item off my property.
 
I sold a dump trailer made out of the back half of an old F350 to a guy 5 1/2 years ago.
He paid for it in full. ($500)
I waited for 2 years for him to pick it up and he never did so I used it and filled it up with shingles when I reroofed the house up at my land.
It sat there in the gravel pit full of shingles till this fall a guy called me and wanted to buy it.
So I looked up the guy I sold it to, told him I had an offer on it and if it wasn't gone by deer hunting season I would resell it.
He said he had looked at it this summer and kind of whined a little about it having a full load of shingles in it.
I just had to chuckle and told him that was the price of storage for 5 1/2 years.
When I came up to hunt it was gone - shingles and all.
It wasn't in my way and if that other fellow hadn't wanted to buy it would have been there still.
But now I'm glad it's gone.

My Dad was like this guy. He would buy stuff that was sitting out for sale, then never go and pick it up. Dad has been gone for 10 years now and I still pass items sitting out that he had bought.
My suggestion to you is just look at the item as "abandoned property" and resell it.
 
Ok so in your case, get a hold of him and set a deadline. I would go with 1 month since it is Christmas season and all and if it's not gone then he gets his money back and you re-sell it.
 
I've got a couple thousand dollars worth stuff around here that people bought and never picked up.A 4 piece set of john deere weights,a set of JD two row cultivators,a farmall belt pulley housing and pulley,etc.I sold a truck feed auger bed to a guy for 2000 several years ago.Never saw him again.My lawyer told me to just sell it and if the guy showed up give him his money back.
 
Call a local legal guy first. Find out how long before it's considered abandoned property in your state. The call the buyer, tell him that by law it's considered abandoned and that you can keep his money and resell it if that's what your state laws say. Then give him a set pickup date as the last day he can pay the balance and pick it up. Then it's up to you if you want to refund what he paid or if you keep part of that money for storage or all of it.

If I were in your shoes in my state I'd call the guy, say you will pay for it and pick it up by this date. If you don't I can keep your money and resell the item or keep it. Then if he failed to pick it up I would resell it and refund half of what he paid with a note explaining that I was being nice giving back anything and the 1/2 I was keeping was for my time and trouble plus storage.

WOW ! Alot of similar stories, people must have more money then they know what to do with to leave it lay around like that. My moneys to scarce to do such things.
 
If you know his name use zabasearch.com to see if he has a mailing address. It's free to do a search. It may also list his phone number. If he has the same number I would send him a letter
by certified mail so he has to sign for it. You can also use peoplefind.com

Reminds me of the ole story of the farmer and the sick mule. Farmer had a sick mule, didn't have the $ to pay for a vet, so he decided to raffle the ole mule off. Went down to the feed store, and put up a flier, and sold about a hundred 2 dollar tickets. One of his buddies asked what ever happened to that mule you were tryin to raffle off. Farmer said he died. Buddy asked, what're you gonna do, refund all that money? Farmer said, I refunded the winner's $2!
 
Give him until January 1st to either pick up the item or his money.

After that he can pick up his money.

Whatever you do make sure you are able to refund his money, and be done with the situation. Just get the guy out of your hair.

Don't try to keep any or all of it for "storage" or "inconvenience" fees. You think you're owed, he certainly won't. It will get VERY messy.
 
I have been through this eric. Laws vary state to state. What lawyer told me was to draw up contract and have him sign it. Something to effect payment must be completed by said date and item piced up by said date OR ITEM REVERTS TO YOU AND YOU CAN RE-SELL IT. uSE THIS FOR FUTURE DEALINGS.
 
Not saying this case fits you but it reminds me of a guy I once knew. He has since passed on to his reward. But he used to go around over the country and buy stuff from "old people" and then never go pick it up. He done it because even though he didn't need or want the item, he considered himself helping the elderly financially. Just kinda of a good deed type thing and most of them really did need the money.
 
I think what people are forgetting is that when you put money down on something, the person is supposed to hold it for you. On the other hand, when you put money down on something, you are saying you are BUYING it. If you don't come after it, you LOOSE your money. Putting money down on something does not mean that if one day before you get it, you decide you don't want it, you get your money back. That's not the way it works. People need to remember that when you put money down on something, it's yours and you need to either get it paid on out and picked up, or loose the money down. Why would any of you expect a seller to take half (or whatever)of his asking price, and then just wait until you get the money, or find a better one cheaper, or whatever, and then expect your money back.
Putting money down means that that money belongs to the seller.
Now if the seller is a good person, and doesn't care, then he could give the downpayment back if the buyer backs out, but should not be expected to.
