Thanks for the information. Only have need of a simple will. All to wife if I go first.Otherwise all divided between three children equally.
 
If its that simple, one of the Internet Sites specific to your State will most likely be fine. Of course, there are other methods to accomplish your goals, some of which avoid the Probate process, but thats between you and your Attorney and I advise NOT for answering here.

I'm not an attorney,But have been though both a Will, and a living trust. The will had some problems, but there was only one kid. With the living trust and three kids it worked great and all three kids GOT everything. If you have a farm there is a lot of planning you need to do NOW. THINK about any Capital Gain.
 
Don't devide equally unless it states that the kids have the right to make the desision as to who gets what. My grandmother didn't do that that and it was a mess, everything had to be sold and one uncle who owed the estate at to pay a bank where it was decided equally among all six including my uncle.
It's always sounds so simple until the courts get ahold of it.

There ends up nothing simple about it. If someone (relative, spouse of some relative) wants to kick up a stir, there will be nothing simple.

child..a Daughter..she"s ok, but her husband is
a looser, just waiting for me to die..and would
cheat/scam, my widow if I go first. Don"t know
what to do, and time is getting short..if wife
went first, i"d leave all to the Salvation Army,
who do some good in this area..not a penny to the
money grubbing church, and their slick shyster
minister!
 
My grandfather split up his farm between his kids already. He has lifetime rights to it all meanwhile the kids got out of paying inheritance tax but they gotta pay property tax while gramps still uses the land seems to be working out so far
 
Grandpa had a simple will drawn up, and his then wife agreed, his kids got his and her kids got hers. Everything was fine till he died, it took four years to argue over an estate worth maybe 40,000.00. If he had left her 10.00 in the will everything would have been fine. Spend 250.00 and see an attorney. What was good in CA. was not good in WA.

One son wanted just money, daughter wanted land and money (a third of cash and property), and final sister (executor) wanted all land. Executor had it twisted in law office was gonna get all land to herself, until someone outside the family offered too much money to the executor. Poof family farm sold and my mother in law just wanted to keep a third of her parents farm. Now its gone forever.

I've seen families squable over wills. Close friend, his mother and one aunt got cheated by another aunt. The guys mom signed over her share of the farm to her 2 sond, one eho has no interest in it at all. The "good" aunt bought out the bad aunt.....now she is in real poor health. She has no children, is estranged from her sister (bad aunt) and nieces, gets along with my buddy and his brother and no one has any idea what her will says. When she dies it's going to be a mess.

Wifes cousins inherated 160 acres from "grandma". Fought over that. Court ordered it sold at fair market. After the six different lawyers got done each got about 3500.

I was supposed to inhearet our farm. Mom knew my sister would contest it so she signed it over to me a couple of years before she passed. Sis got everything else. I had no problem with that.

WIfe is one of 6 kids. 5 of them including my wife really don't care about her moms property or money. One brother is most likely going to try to break her will. But that's OK. One of her brothers (really good guy) married into money. His wife says when the mother in law passes if the jerk tried anything she will pay for a lawyer to represent the rest, a good lawyer.

So please spend the money to talk to a lawyer! Lot of of them will give a low cost consult first and be able to spell out tour options in your state.
