JD E- oil guard question

I'm in the process of replacing the oil pan, due to the typical rust holes letting oil get into the gas. I found a piece of strap, about 1 1/4" wide, 1/16" thick, and 6" long down in the bottom. I think it must be a leg from the oil guard (E 2187 RT). These are two legs that hang on each side of the piston rod and just behind the piston's stroke. The other leg was already gone. How vital are they to the engine's operation? I notice that the 3 and 6 hp engines don't show them in the parts breakdown. I'm guessing they keep too much oil from flying up to the piston and causing excessive oil consumption. Also, approximately, how much oil does it take to fill it? TIA!!
 
Don't know about the importance of the guard but be real careful installing the new oil pan and gaskets. I did 2 engines over the winter and had to redo both of them. I found it is a lot easier to do if you can set the engine on a table and rock it back on the flywheels where you can easily work on the bottom. Use a good quality silicone oil resistance sealer.
 
We made our own pan plate and fuel tank from sheet metal, reusing the oil cup (3 HP) from the old pan plate.
we used no gaskets, only For oil pan gaskets, 3M 8002 adhesive @ $6/tube.
