You might consider adjusting the governor linkage.
Reviewed the [b:654c4848f0]SERVICE MANUAL SM2013 JOHN DEERE 40 SERIES TRACTORS AND CRAWLERS[/b:654c4848f0] in the [b:654c4848f0]Governor[/b:654c4848f0] section under the [b:654c4848f0]INSTALL AND ADJUST GOVERNOR LINKAGE[/b:654c4848f0] heading in the [b:654c4848f0]Governor Connecting Rod[/b:654c4848f0] topic on page 70-5-6.
Take a look at the diagram below.
Note the speed control lever (Key 2), governor control rod (Key 7), and connecting rod (Key 15).

?[b:654c4848f0][i:654c4848f0]Move speed control lever counter-clockwise as far as possible (slow-idle position).
Slip flat washer over end of control rod ( B ) and slide connecting rod ( A ) into place on control rod.[/b:654c4848f0][/i:654c4848f0]?
Take a look at the photo below.
?[b:654c4848f0][i:654c4848f0]Push governor lever ( C ) as far down as possible and turn adjustable yoke until hole in yoke lines up with the hole in governor lever. Then unscrew yoke two complete turns. This insures that governor lever is tight against stop pin when governor control rod is against stop on control rod front bracket. Insert pin through yoke and governor lever and secure with cotter pin. Tighten lock nut on connection rod against adjustable yoke.[/i:654c4848f0][/b:654c4848f0]?

?[b:654c4848f0][i:654c4848f0]Move speed control lever to its wide open position and install second flat washer and spring on control rod ( B ). Be sure spring is seated in grooves provided for it.[/i:654c4848f0][/b:654c4848f0]?

?[b:654c4848f0][i:654c4848f0]Insert the ball joint of governor-to-carburetor connecting rod ( E ) into governor operating shaft lever from outer side. Tighten nut securely.[/i:654c4848f0][/b:654c4848f0]?
Take a look at the photo below.
"[b:654c4848f0][i:654c4848f0]With the speed control lever in the wide open position, move the carburetor throttle shaft arm ( F ) as far forward as possible. Adjust length of governor-to-carburetor connecting rod ( E ) until it will just slide into hole in carburetor throttle shaft arm. Then turn rod into ball joint two complete turns, and secure it to carburetor throttle shaft arm with cotter pin. Tighten lock nut against ball joint.
CAUTION: Check to make sure that air cleaner bracket does not interfere with governor lever movement.[/i:654c4848f0][/b:654c4848f0]?
