Misrepresentation ??

Looking for your opinions on the subject. Is it right/legal for a seller to represent an aftermarket part/assembly as a "rebuilt" or "remanufactured" version of an original (OEM) piece? Specifically a JD/Marvel Schebler DLTX carb. Photo clearly shows "cast in " wording on side of float bowl "A & I ..Made in (country unlegible). Choke lever/spring load/cover not same and doesn't even have hash mark to show choke orientation. These are just what one can see from ONE photo angle which is all they provide. Castings are way too smooth. Who knows what internal parts are or whether one can get replacements? I e-mailed seller (large company) and they told me these were NOT aftermarket and they were in fact originals that they had completely re-built. Pure BS IMHO. I'm sure some of you have seen them. Not saying aftermarket doesn't have it's place in the restoration hobby and for general use. The issue is "misrepresentation" and why this country seemingly allows it freely. Ok,rant's over. Is it just me?
 
They may be correct. There was an article in GM several years ago about someone buying the patents, schematics and tooling for the MS carbs. They were supposed to start manufacturing them again but I haven't heard anything since then.
 
...and have no problems with that if in fact they have succeeded in doing that. His exact words were that it was a rebuilt, bead blasted etc Marvel Schebler carb. Also ad says $ 300 for a DLTX 71 and "price includes a refundable $ 200 core charge. So you are going to get a # 71 for a net cost of $100?? And in the process they are going to get your real "original" 71 which when completely rebuilt correctly will bring $ 350 - $ 400. Just wondered if it sounded a little fishy to anyone but me.
