Homemade farm trailer titled to deceased person?

Farm trailer with ball hitch sat in shed for 35 years. Unused. Found title. Titled to person whose has been deceases for about 35 yeats. How
does one sell or auction off this trailer?
 
it probably depends on your state. In Florida you could get a homebuilt title years ago, but rules change. Google it.
 
County Clerk's office where he expired will have a copy of the death certificate. Take that and the title to the County Tax office and get your new clear title and then put it up for sale.
 
In North Carolina, you would have to get with the executor/administrator of his estate and/or petition the clerk of court to reopen the estate in order to dispose of the property. Mainly paperwork and I think not very expensive.
 
In Ohio NO title on any home built trailer, actually none either on lower capacity factory built trailers either The 2 7000# capacity trailers I have never came with a title, just a certificate of origon and is not recorded at any place Nor transfered at any time as it only has manufactures information on it, not anything to who it was sold to.
 
In VA the legit way would be to go to DMV get the papers and apply for a title,a parts yard can get one easily.The not so legit way is to knock off the serial number tag and apply for a
homemade trailer title.
 
Last time I checked Texas has no title on a trailer, nor a trailer tag either for certain farm use only trailers....others have a Farm Tag available from your County Tax Office.....couple of years ago bought a 5x8 from TSC. No title requirement, nor tax paperwork for licensing, so I guess it's still a no title state with farm exemptions for tagging requirements.
 

If it is homemade, there most likely is NOT a serial number, or V.I.N. If there is not a V.I.N., then how can it be traced back to anyone?
 
Homemade so it would not have a serial number. So no number to get rid of. What state did ever issue a title to it? Dosen't sound right a home built unit having a title.
 
I really depends on which state the trailer is licensed in, few states handle things like that exactly the same way. The executor of the estate will be the one who needs to take care of it, or delegate someone to do it.

Check with your state DMV. Coming to a site like this and asking a question like that gives you a 100% chance of getting incorrect info sooner or later.
 
He said "Farm trailer" he did not say homemade trailer.
It could be a stripped to the frame old travel trailer, which would have a title in most states.

He did not say who owns the trailer. He just found it in a barn.
I would say whoever owns the barn owns trailer.

The legal way would likely be thru the court system.
But then some heir could pop up and claim it as part of their inheritance.

Sign it off yourself with a date prior to his death, if your feeling lucky.
 
Agreed - it depends on the state. In some states it easy - in a state like Kansas with the estate closed it would be virtually impossible to get a title if the last registered owner (in Kansas) was dead. However - if it had never been registered in Kansas getting a title issued is a breeze.
 
First word in post heading was homemade followed up with farm trailer so yes he did say homemade.
 
Better call the DMV.

I bought a fifth wheel trailer in Indiana with out a title. I was told it was lost and living in Ohio I could get a title by having the DMV inspecting it with a weigh ticket. DMV told me I would have to take it to Lima Ohio and to get it inspected and gave me a phone number to make an appointment. When I called the inspector he told me after I told him what I had and I couldn't locate a vin number to get that trailer back to Indiana as quick as I could. He said you do not want that trailer in your possession until you have a title. The Indiana police was sure it was a stolen trailer and it took them six months with several inspections with pictures at the old owners place before they issued a vin number. It can get nasty!
 
In Virginia any trailer other than a farm use trailer has to be licensed and to get a license for it,it has to be titled.Once you build a trailer the builder calls the State Police and they send a trooper by to inspect the trailer and put an ID number on it.

I would get a weight at a state certified scale and take it to DMV in Michigan and tell them it's a shop build. About. 75 bucks and you would have a livetime plate and be good to go. Been there and done that.
 
Ohio about same but NO lifetime plate, Would ask for a guess as to year. And color. Have 2 homebuilt trailers now with tags. That is all it took. Scales at local grain elevator. Larger one I bought about 20 some years ago with no brakes, before I found out about trailer brakes, added them even tho weight is below requirements. 2,250#. Second I built several years ago using a Chevy car axle of the 30's so no brakes but only weighs about 700#. I have others that no longer using but same procedure since the one was made in the 40's and other in 60 and had tags off and on on both. Where I live in Ohio trailers of this size are only required to have 2 wheel brakes, 40 mile across state line Indiana requires 4 wheel brakes if titled in that state . But with me from Ohio and Ohio tags if used or just an SMV I am legal to cross state line that I do all the time. Taking the homemade tandam axle into Indiana this afternoon.
