He posted on a forum! He's called numerous times and left numerous messages. It would be in the other guys best interest to call him back. How many times should he have to leave a message or how long should he wait? 100 messages or 2 years, which ever takes longer? Maybe if he does advertise the tractor again it won't sell or will sell for less. Should he have to lose money because someone expects him to hold the tractor indefinately and won't even let him know what's going on? I wasn't ordering him around. I gave him a suggestion that I think others would agree with. Do you think a dealer would hold a tractor for months on end and keep phoning and leaving messages? There comes a time when you have to say enough is enough. If the guy wants any of his deposit back, he should call. If you take something in for repairs and leave it too long, the shop has a legal right to sell it. He could have lost a lot of prospective buyers waiting to hear back from the guy. Dave |

| Not sure I would use a "dealer" as a back board on this one. Many dealers would have us believe that money is more important to them than it is us. That is how they try to justify always trying to get the bigger end of the stick, instead of just making fair deals where both parties come out good. It appears that this seller is one to model. He is going beyond the call of duty, not just being stupid greedy thinking, "ummmm, got $1,000 and still got my tractor, what a deal!" The high road is to always try to do what is right, the low road is extremely crowded these days and is getting worse. |

| I think he's done just about everything he can to get a hold of the guy. He's got $1000 and still his tractor. That's the point. He'd rather not have the tractor and have the rest of the money that was agreed upon. He's not taking the low road if the guy won't contact him after repeated messages. I think from a legal stand point, he could take the guy to court for the rest of the money and give him the tractor in exchange. The guy that gave the deposit is the one that has to do something, anything, instead of just ignoring all the calls. The seller has given the guy every opportunity but the guy has his head in the sand. Dave |
