Rex Merrett of Australia

Has anyone dealt with this person, particularly when he was the buyer? Did you have any trouble with him paying for a tractor, but not getting it picked up? I sold him a John Deere 70 Diesel in April, 2008. He paid for it, but has never sent anyone to pick it up. I keep hounding him to get it picked up, or let me resell it and send him his money back, but he only sends vague replies that he will get it picked up at some point in time. Should I start abandonment proceedings, or should I still hold out a little hope? I'm just getting dang sick of having that tractor still underfoot.

Thanks,
Lyndon

After this long of time.I would send his money back or start charging him a storage charge for each day not picked up.

I have been there and done that and I dont agree with replys that suggest you owe this guy anything (as usualy get posted). 1 1/2 years is beyong funny, he is using you plain and simple. I have seen people post who were actualy complaining because somebody sold "their" property,, after they had left it sit for three years, LOL. In my case I simply sent the dead beat a letter telling him you have until X to remove your property from my property or I will have it removed. Any proceeds from that removal and disposal will be forwarded to you minus any costs I occur removing it.

Is the tractor in the way. As long as it's paid for what's the problem. Depending on what kind of agreement you made with the guy at time of sale. I am sure it's not all that easy to find a ride for it all the way to Australia from Canada. If it's in the way then give him a deadline. Depending on law in your area after certain time frame you wouldn't have to return the money. Like me I would have probably spent the money and not have it to return. Let your conscious be your guide.

long as it paid for and dont eat anything....what the heck..use it for lawn art till its picked up.....this aussie aint a dead beat...HE PAID FOR IT.....he just a lil slow..what i dont understand is why anybody would buy a J D in the first place....BUHAHAHAHA..at least it will be half a world away....BUAHAHAHAHAH

Lyndon: I have dealt with Rex on 1 ocassion.Sold him 2 JD R's. Was very leary to deal with someone overseas? But, sent me the money and also talked to him over the phone several times during the deal. Yes, the tractors set here for months also. I live in south Texas. The shipping company from North Texas contacted me when they could pick up the tractors and everything went fine. The trucker says that he has a dozer service and his son comes to the states and buys parts for the cats. When they have enough to fill up a shipping container, they haul it to the port for shipment. I understand your getting tired of having the tractor around, but in my opinion he is going to take care of the deal. Mike
