Warning to everyone. I supposedly bought an Oliver tractor from Vern Otto from Beausejour, Manitoba, Canada. It was posted in the Photo Ads. I wired him money as requested and was told the tractor would be shipped within a couple weeks. I hadn’t heard anything and dropped him an email to see where things were.

I got a “story” back about the fact that the tractor I had “bought” had been sold by the actual owner and Vern hadn’t paid for it. In the meantime he says he used my money to buy another tractor and will send my money back “in time”. At this point I’m out a little over $3,500 and am evidently acting as Vern’s banker.

I called him twice and he hung up on me both times. When I told him I would post it on ytmag.com to warn everyone he told me he’d take a long time to get my money back to me. A warning to anyone who is buying a tractor from him – DON’T!!! Drop me an email or give me a call if you like and I can give you more details.

I am one of the people VERN screwed ..This buyers and sellers fourum was started just because of this guy YES it was VERN Otto that this was started for I am so sorry this happened again besause of this guy I have stoped working on my tractors..Please dont let this happen to anyone else ....Vern is just bad news nothing he says is the truth.....

I'd make contact with your local court system. Spending about 40 bucks to file small claims and placing a reasonable amount plus what was cashed in the wire transfer should get his attention. He would have to travel to the court who filed on him for proceedings. It would easily cost him more to show up than what he spent of your money. It will get his attention and hopefully expedite your recovery of funds. I'd also add the fees to file as well as lost wages to take the time to do the paperwork.

Does the local court system have jurisdiction over Canadians? If one goes into any court US or Canada you better have evidence such as an invoice,serial #,promised delivery date and any other evidence some mutual agreement occurred which has since been broken. If the seller promised verbally to send you a tractor if you first send the money then all you have really purchased is a promise. If he sends the money back you should feel quite fortunate. I have purchased tractors from several individuals and auctions in Canada. Each time that I have wired funds to pay those transactions my banker has given very specific warnings: If the deal goes bad,we have absolutely no recourse in getting your money back or getting the seller to deliver on his promises.

You sent an individual a payment. The payment originated from your local town. You can file in your local court OR you can file in the Canada location to where the money was received. Either one, you would be in a civil suit with a person, not a country. File it here and let the court (or your attorney) send a certified letter with the court hearing date. As far as the banker having anything to do with the deal, he does not. He only provides your evidence that the funds were sent and received. Thats your copy of the receipt. You entered a verbal contract with that person. My guess is that he will see things your way once he is informed that he needs to travel to the states for a civil suit. Either that or you will receive your cash, or the tractor that you already paid for. For 3500 bucks, I'd spend a little more to get it back with my costs added on to recover from the scam. You have his bank routing number, subpoena his personal info using a discovery subpoena directly to the bank. Call his bank and tell them you sent a cashier check to them and received nothing in return. They may at least hear your story, maybe not. If its a small town where he lives, the word may get out. Also, if your local courts are like ours, there is volunteers waiting to help at sometimes no cost to you. Good luck.

I too got screwed by this seller. Buyer's beware. The tractor was nothing he claimed it to be. the thing was a wreck! He claimed the engine had 100 hr"s on an overhaul, but was never touched. The tires were claimed to be very good, but were originals and totally dry-rotted. broken windows, moss growing on floor in cab, must have been in a grove for three or four years. DON"T TRUST THIS GUY. I"m sorry I didn"t see this forum before.

There have been several bad reports on this seller over the past few years. He always comes to his own defense and always blames it on the buyer. You know how sorry those buyers can be.
Where do these guys get off thinking that they can do this and get by with? I guess he has been getting by with it for a long time.

This is the typical Tractor Jockey and there has been some bad reports in the past. In conversations with him you get very little detail and he always states there is another buyer with an offer. I try and stay away from these types.

I take offense at the term "typical tractor jockey"

This guy is NOT typical...I have dealt with various jockeys for over 40 years and there were more good honest ones than there are bad ones like this case seems. I just seems they are getting harder to find nowdays

ps I am not a jockey unless buying a tractor once a year makes you so...I buy and sell scrap
